Who to blame?

    When a pedestrian (jaywalker) crossed about 100 meter from the zebra corssing they might risk themselves get hit by motorist. When they get hit, who should be blame? the driver or the pedestrian who fail to use the zebra crossing?

    Of course the pedestrian is at fault. By law, he/she is not on the zebra crossing anyway. But also bear in mind that, in Malaysia, very often, car drivers just wont slow down or stop at zebra crossing! I find this very freuquently happening at LCCT/KLIA, esp those taxi drivers!

    Normal things lah, these is Malaysia culture, unless to migrate to Singapore... Singaporean more respected to the prdestrian... Sigh, dont't know is government fault or the driver fault or the road fault...

    y u always blame n said the bad things to malaysian people?
    we should respect each other. singaporean are good?
    most of them always speeding in our road u know. cant u see?
    what we shud do is, try to admit our weaknesses n change to be the better one.
    we are together to protect our life in the road. make our road safe!!!

    When a pedestrian got hit by a car,
    These questions must be taken into account..
    1) Is the driver driving within the speed limit?
    2) Is the driver driving under the influence of medication/alcohol?
    3) Is the driver speaking to the phone (without handsfree)?
    4) Did the driver make enough effort to alarm the pedestrian?
    5) Did the pedestrian run out to the middle of the street blindly?

    I am not a lawyer, but if the driver is all clean and that the pedestrian dashed into the street only to get hit, then there is a case and can be fought in court.

    I hate to agree with ktong, but the drivers in S'pore really do respect pedestrians.
    When driving there initially, I felt immense pressure as to look after the pedestrian and to virtually stop for them to cross the road.

    If we do that in Malaysia, we will surely get hit from the back.
